  • hold, or for some people, must have held, a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream or Significant Investor Extension stream, and
  • continue to hold your complying investment or complying significant investment, as required for your subclass 188 visa, during the period of that visa
  • have a current nomination from a state or territory government agency or Austrade which has not been withdrawn.

With this visa, you can
  • stay in Australia permanently
  • work and study in Australia
  • attend free English language classes through the Adult Migrant English Program, if eligible
  • enrol in Australia's public health care scheme, Medicare
  • sponsor your relatives to come to Australia
  • travel to and from Australia for 5 years
  • if eligible, become an Australian citizen.

Newly arrived residents may need to wait before they can access certain Australian Government payments and benefits.

How long you can stay

This is a permanent visa. It lets you stay in Australia indefinitely.

For citizenship purposes, your permanent residency starts on the day:

  • we grant the visa, if you are in Australia
  • you first enter Australia on this visa, if you are outside Australia when we grant this visa
Include family

You can include members of the family unit in your application when you apply. You can also add members of the family unit to your application at any time before we decide on your application.

Family members who apply for the visa must meet our health and character requirements.

Family members who are not coming to Australia might also have to meet our health and character requirements.

Cost

From AUD4,375.00 for the main applicant (concessions apply in limited circumstances).

There is also a charge for each family member who applies for the visa with you.

You might have to pay an extra charge for any applicant 18 years old or older who has less than functional English. This charge is the second instalment charge. Pay it only when we ask you to. We ask for the charge only if we are going to grant the visa.

The second instalment charge is AUD4,890.

You only need to pay it for family members who did not pay the second instalment charge for their Business Innovation and Investment (Provisional) visa.

Cost concession for eligible Pacific Island and Timor-Leste visa applicants

From 1 July 2026, a lower visa cost applies to eligible Pacific Island and Timor-Leste citizens who lodge a valid visa application.

We will charge eligible applicants the lower visa application cost during the application process in ImmiAccount. We will recognise eligible applicants by the valid passport from the specified countries used in the application when they apply.

Family members are also eligible for the lower visa cost. We base this on the passport of the primary applicant (or visa holder who satisfies the primary visa criteria).

The primary applicant must hold a valid passport issued by one of the following countries:

  • Federated States of Micronesia
  • Fiji
  • Kiribati
  • Nauru
  • Palau
  • Papua New Guinea
  • Republic of the Marshall Islands
  • Samoa
  • Solomon Islands
  • Timor-Leste
  • Tonga
  • Tuvalu
  • Vanuatu

You can be in or outside Australia when you apply for the visa and when we decide on your application, but not in immigration clearance.

Processing times

There are no standard processing times available for this stream.

Your application may take longer to process if:

  • you do not complete the application form correctly
  • you do not include all the documents we need or we need more information from you
  • it takes us time to verify your information

We cannot process your application if you do not pay the correct visa application charge. We will notify you if this is the case and if necessary return your application.

Your obligations

You and your family members must obey all Australian laws.

If you are outside Australia when we grant the visa:

  • you and your family members must enter Australia by a certain date (we will tell you when this is)
  • any family members included in your application might not be able to marry or enter into a de facto relationship before they enter Australia (we will tell you if this is the case)
Travel

You can travel to and from Australia as many times as you want for 5 years from the date we grant this visa. This is as long as the travel facility on this visa remains valid.

If you want to travel after the initial 5-year travel facility:

  • you will need to apply for and be granted a Resident Return (RRV) so that you can re-enter Australia as a permanent resident
  • you might also want to consider Australian citizenship. If you become an Australian citizen, you don't require a visa to enter Australia. You will need to apply for an Australian passport and use it to leave and re-enter Australia. See more about eligibility requirements and current processing times for Australian citizenship

If you leave Australia after the expiry date of your travel facility, without being granted another permanent visa with a valid travel facility, for example a Resident Return (RRV), you will not be able to return to Australia as a permanent resident.

You must be the holder of one of the following:

  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor. If you were invited to apply for this visa on or after 1 July 2021, you must have held this visa for at least 3 years.
  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor Extension stream.
  • Business Innovation and Investment (Provisional) visa (subclass 188) granted on the basis that you were the spouse or de facto partner of a person who held a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream or Significant Investor Extension stream and:
    • you have held this visa for at least three years if the primary visa holder was invited to apply for their Business Innovation and Investment(Provisional) visa (subclass 188) in the Significant Investor stream or Significant Investor Extension stream on or after 1 July 2021
    • either you have ceased to be the spouse or de facto partner of the primary visa holder or the primary visa holder has died.

You can also apply if you are the secondary holder of a Business Innovation and Investment (Provisional) visa (subclass 188) and your spouse or de facto partner is the primary holder of a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream. If the primary visa holder was invited to apply for their original Business Innovation and Investment (Provisional) visa (subclass 188) on or after 1 July 2021, you must have held your visa for at least 3 years.

COVID-19 concessions

Arrangements were in place for provisional visa holders who may have been disadvantaged as a consequence of the COVID-19 pandemic.

From 1 February 2020 until 3 months after the end of the ‘COVID-19 concession period’, you were able to apply for this visa if you held a Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor stream or Significant Investor Extension stream which expired during the concession period.

From 1 February 2020 until 3 months after the end of the ‘COVID-19 concession period’, you were able to apply for this visa if you were the secondary visa holder of a Business Innovation and Investment (Provisional) visa (subclass 188) and:

  • your visa expired during the ‘COVID-19 concession period’
  • you have ceased to be the spouse or de facto partner of a primary holder of a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream or the Significant Investor Extension stream
  • the primary visa holder has died.

Your family members who wish to apply for the visa must combine their application with your (the primary applicant’s) application. The family members do not need to hold a Business Innovation and Investment (Provisional) visa (subclass 188).

Be nominated

You must have a current nomination from a state or territory government agency or Austrade.

When you applied for your provisional visa, you gave us an expression of interest. A state or territory saw your expression of interest and nominated you.

You do not need to provide a new expression of interest. But, the state or territory needs to confirm that your nomination is still current, for details see the Step by step tab

Have held your complying investment or complying significant investment for the required period of time

When we granted your Business Innovation and Investment (Provisional) visa, you invested AUD5 million in a ‘complying investment’ or a ‘complying significant investment’.

To be granted a Business Innovation and Investment (Permanent) (subclass 888) visa, you (or you and your spouse or de facto partner combined) must:

  • for the whole period during which you held your Business Innovation and Investment (Provisional) (subclass 188) visa, have held a ‘complying investment’ (if your subclass 188 visa was granted on the basis of an application made before 1 July 2015) or a ‘complying significant investment’ (if your subclass 188 visa was granted on the basis of an application made on or after 1 July 2015),
  • tell us of any times you transferred funds from one investment to another.

If any part of your investment is or was a direct investment in an Australian proprietary company, then:

  • if the period of the direct investment was less than 2 years, the company must have been a qualifying business for the whole period, or
  • if the period of the direct investment was 2 years or more, the company was a ‘qualifying business’ for at least 2 years, or
  • if the company has been unable to operate as a ‘qualifying business’, you must have made a genuine attempt to operate the business as a ‘qualifying business’.
Changes to investment rules

Investment rules for the Significant Investor stream changed on 1 July 2015. The rules in force when you applied for your Business Innovation and Investment (Provisional) visa will stay the same for your permanent visa.

Meet the residence requirement

You must meet one of the residence requirements below.

Unless COVID-19 concessions apply, to be granted a Business Innovation and Investment (Permanent) visa (subclass 888), you (the primary applicant) must have held a:

  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream for a continuous period of 4 years or
  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream and one or more Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor Extension stream for a continuous period of 4 years or
  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream applied for before 1 July 2015, for a continuous period of 3 years and 11 months

Unless Covid-19 concessions apply, if you applied for this visa and are the secondary visa holder of a Business Innovation and Investment (Provisional) visa and your spouse or de facto partner is the primary holder of a Business Innovation and Investment (Provisional) visa in the Significant Investor stream you must have held a:

  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream for a continuous period of 4 years or
  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream and one or more Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor Extension stream for a continuous period of 4 years or
  • Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream applied for before 1 July 2015, for a continuous period of 3 years and 11 months

Unless Covid-19 concessions apply either:

  • you must have been in Australia for at least the number of days worked out by adding the results of paragraphs (a) and (b):
    • (a) 40 multiplied by the number of complete years in the period in which you held a subclass 188 visa in the Significant Investor stream, and
    • (b) 40 multiplied by the number of years (if any) (treating a part of a year as one year) in the period in which you held a subclass 188 visa in the Significant Investor Extension stream

or

  • your spouse or de facto partner who is the primary visa holder must have been in Australia on a subclass 188 visa, granted on the basis that you held a subclass 188 visa in the Significant Investor stream or the Significant Investor Extension stream, for at least the number of days worked out by adding the results of paragraphs (a) and (b):
    • (a) 180 multiplied by the number of complete years in the period in which you held a subclass 188 visa in the Significant Investor stream, and
    • (b)180 multiplied by the number of years (if any) (treating a part of a year as one year) in which you held a subclass 188 visa in the Significant Investor Extension stream.

COVID-19 concessions

Arrangements are in place for provisional visa holders who may have been disadvantaged as a consequence of the COVID-19 pandemic.

During the ‘Covid-19 concession period’, time spent overseas will count as time being in Australia:

  • if you held a Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor stream or Significant Investor Extension stream that expired during the concession period; or
  • your visa expired during the concession period and your spouse or de facto partner was the primary holder of a Business Innovation and Investment (Provisional) visa in the Significant Investor stream or Significant Investor Extension stream.

The Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream that expired during the concession period must have been granted on or before 30 June 2019.

Not have been involved in unacceptable business or investment activities

You and your spouse or de facto partner must not have been involved in any business or investment activities that are unacceptable in Australia.

Have a realistic commitment to continuing business or investment

You must have a realistic commitment to continue your business or investment activity in Australia.

Have followed Australian laws

If you operated a business in Australia, you and your partner must have followed:

  • Commonwealth laws
  • the laws of the states or territories where your business operated

This includes laws about taxation, superannuation and workplace relations.

Have functional English

All applicants aged 18 or over at time of application, who did not pay a second instalment of the visa application charge for a previous subclass 188 visa application must have functional English. If you cannot show evidence of functional English, you will be asked to pay the second instalment of the visa application charge.

They will not need to pay a second instalment if they have already paid a second instalment of the visa application charge in relation to an application for a Subclass 188 (Business Innovation and Investment (Provisional) visa.

Do not make a second instalment payment until we ask you to.

Meet our health requirement

You and any family members who apply for the visa with you must meet our health requirement.

Family members who are not coming to Australia might also have to meet our health requirement.

Meet our character requirement

You and family members aged 16 years or over who apply for the visa with you must meet our character requirement.

Family members who are not coming to Australia must also meet our character requirement.

Sign the Australian values statement

If you and your family members who have applied for the visa are 18 years of age or older at the time when the application is decided, you and your family members must:

Have no debt to the Australian government

If you or any family members owe the Australian Government money, you or they must have paid it back or have an approved arrangement in place to pay it back.

Not have had a visa cancelled or a previous application refused

We will consider your immigration history when we make a decision on your application, which means you might not be eligible for this visa if you have had a visa cancelled or refused.

When to apply

The criteria for the grant of the subclass 888 visa in the Significant Investor stream include criteria relating to how long you (the primary applicant) have continuously held your Business Innovation and Investment (Provisional) (subclass 188) visa.

When you can meet the criteria for the grant of the subclass 888 visa depends on:

  • the visa you hold when you apply
  • when you applied for that visa.

If you currently hold a subclass 188 visa in the Significant Investor stream, which you applied for before 1 July 2015, you can only be granted a subclass 888 visa if you apply for the visa within a 1-month window which:

  • begins 3 years and 11 months after your current subclass 188 visa was granted
  • ends 4 years after your current subclass 188 visa was granted

If you currently hold a subclass 188 visa in the Significant Investor stream, which you applied for on or after 1 July 2015, you can only be granted a subclass 888 visa if you apply for the visa within a 3-month window which:

  • begins 4 years after your current subclass 188 visa was granted
  • ends 4 years and 3 months after your current subclass 188 visa was granted

If you currently hold a subclass 188 visa in the Significant Investor Extension stream, you can only be granted a subclass 888 visa if, when you apply:

  • you have held a subclass 188 visa in the Significant Investor stream and the Significant Investor Extension stream for a continuous period of 4 years

You and your family members must have valid passports or travel documents for this visa.

You must give us documents proving your identity and about your business or investment activity. You also need to provide documents about family members applying with you.

Provide accurate information

You are obliged to prove your identity and provide true information with your application. See what happens if you can't prove your identity or don't provide true information.

Identity documents

You and family members who apply for the visa with you, must provide:

Colour copies of the pages of your current passport showing photo, personal details, and passport issue and expiry dates.

Also provide:

  • a national identity card, if you have one
  • proof of change of name, if applicable

Documents that prove a change of name include:

  • a marriage or divorce certificate
  • change of name documents from an Australian Registry of Births, Deaths and Marriages, or the relevant overseas authority
  • documents that show other names you have been known by

Other relationships

Provide a death certificate, divorce or separation documents, if anyone in your application has been:

  • widowed
  • divorced
  • permanently separated

Also provide marriage certificates or relationship registrations for you and anyone applying for a visa in your application.

You do need to have a current nomination from a State or Territory government agency or Austrade.

Fill out Form 1414 Nomination - Business Skills class. Then:

  1. send the form to the state or territory that nominated you
  2. the state or territory will fill out the form and send it back
  3. include the completed form with your application

Commitment to your business and investment activity

Provide:

  • a 1-page summary of your current business and investment activities in Australia
  • a 1-page summary of your Australian business and investment intentions in the long-term

Following Australian laws

Show us you and your spouse or de facto partner have followed Australian laws if you operated a business in Australia. This includes laws about taxation, superannuation and workplace relations. Provide:

  • a written declaration stating you and your spouse or de facto partner have complied with the laws of the Commonwealth, and of the State or Territory where your business is located
  • details of any time you breached the laws of the Commonwealth, and of the state or territory where your business is located

Investment documents

When we granted your provisional visa, you invested AUD5 million in line with investment rules for the Significant Investor Visa. We call this a 'complying investment' or a ‘complying significant investment’ (depending on whether you applied for your provisional visa before 1 July 2015, or on or after that date).

Provide evidence:

  • that you held a complying investment or a complying significant investment (as applicable) for the entire time you held your provisional visa
  • of any transfer of funds from one complying investment to another, or from one complying significant investment to another (as applicable)

The rules for complying investments changed on 1 July 2015. For that reason, the evidence you need to give us depends on when you applied for your provisional visa.

Provisional visa applications submitted on or after 1 July 2015

If you applied for your Business Innovation and Investment (Provisional) (subclass 188) visa on or after 1 July 2015, evidence of your complying significant investment can include:

Provisional visa applications submitted before 1 July 2015

New step summary

If you applied for your Business Innovation and Investment (Provisional) visa before 1 July 2015, evidence of your investment can include:

  • a bond holding statement from the Australian Government or an Australian state or territory government
  • holding statements for all investments in managed funds

All holding statements must show the investor name, amount and commencement date.

For all managed fund investments, a new Form 1413 Declaration in relation to managed funds must be provided to confirm that it complied with our investment rules throughout your investment

If you invested in an Australian proprietary company, give us:

  • evidence that the company was operating to make a profit through providing goods or services to the public
  • evidence that the company was not operating as a passive or speculative investment, such as a landlord of residential property, gambling, share trading, or holding property for capital gain
  • a recent historical company extract from the Australian Securities and Investments Commission
  • audited accounts, including profit and loss statement, balance sheet, and all notes to the accounts, for each financial year of the investment

Your evidence must cover a period of:

  • at least 2 years if your investment in the business was for 2 years or more, or
  • for the whole period of the investment in the business if it was for less than 2 years

Health documents

You do not need to provide health documents. The doctor will send them to us.

Character documents

You and all applicants aged 16 years and older, provide:

Proof of functional English

Provide proof that all dependent applicants aged 18 years and older, who did not pay the second instalment of the visa application charge at provisional stage, have at least functional English.

If you can't provide functional English documents

If any of the dependent applicants, who did not pay the second instalment cannot show evidence of functional English, you will need to pay the second instalment of the visa application charge for each of those dependent applicants, when we ask you to.

Partner documents

If your partner holds a Business Innovation and Investment (Provisional) (subclass 188) visa application as your dependent partner, we do not need evidence of your relationship.

If you are including a partner who does not hold a subclass 188 visa as your dependant, we need to see evidence of your partner's relationship with you along with identity and character documents and documents about other relationships.

Provide:

  • identity documents and photos
  • character documents
  • documents about other relationships, if applicable

Provide either:

  • your current marriage certificate or
  • enough documents to prove you have been in a de facto relationship with your partner for at least 12 months before you apply

Documents that prove your de facto relationship include:

  • joint bank account statements
  • billing accounts in joint names
  • joint leases or mortgages
  • documents that show you have lived at the same address as your partner

Dependants under 18 documents

For every dependent under 18 years old who is applying with you, provide:

  • identity documents and photos
  • proof of your relationship with them, like a birth or marriage certificate
  • character documents, if applicable
Parental responsibility documents

You must get consent for a dependent child to migrate to Australia from anyone who:

  • has a legal right to decide where the dependant lives and
  • is not coming to Australia with the dependant

They must complete either:

Include a document with the contact details, signature and photo of the people who complete the form or declaration, such as a:

  • passport
  • driver’s licence
  • National Identity Card

Alternatively, you must provide evidence:

  • A court order that allows your child to migrate to Australia, or
  • Documentation showing that the laws of the child's home country allow them to leave their home country

Note: If your child is likely to turn 18 while your application is being processed, you will need to provide evidence they are dependent on you. See the section 'Dependants over 18 documents' below for further information. A child who turns 18 while your application is being processed and who is not dependent on you cannot satisfy the criteria for this visa.

Dependants over 18 documents

If you are including a dependant aged over 18 years of age who holds an eligible visa (Class UR or Class EB) granted on the basis of being a member of your family unit at time of grant, this section does not apply.

To include your child who is over 18 in your visa application, they must be:

  • over 18 years of age but not yet turned 23, and dependent on you or your partner, or
  • over 23 years of age and unable to earn a living to support themselves due to physical or cognitive limitations and dependent on you or your partner

If your child is likely to turn 23 while your application is being processed, you will need to provide evidence they are dependent on you due to disability.

Provide:

  • identity documents
  • documents about their other relationships, if applicable
  • character documents
Proof of dependency

If you are including a dependant aged over 18 years of age who holds an eligible visa (Class UR or Class EB) granted on the basis of being a member of your family unit at time of grant, this section does not apply.

Otherwise, you must demonstrate that the child is dependent on you, by providing:

  • proof of your relationship with the dependant such as a birth certificate or adoption papers
  • a completed Form 47a Details of a child or other dependent family member aged 18 years or over
  • if the child is aged 23 or is likely to turn 23 while your application is being processed, you must also provide a report from a qualified medical practitioner that states they are dependent on you or your partner due to the total or partial loss of their bodily or mental functions

You must also prove this person has been financially dependent on you for at least 12 months before you apply. You could provide:

  • proof they live with you
  • their tax records
  • proof they are currently studying
  • proof of payments made by you to them or on their behalf

Note: A child who turns 23 while your application is being processed and who does not meet these requirements cannot satisfy the criteria for this visa.

Travel after you apply

You don't have to tell us if you want to travel outside Australia while we process your application. This is because you can be outside Australia when we make a decision.

But if you leave Australia, you must make sure you have a valid visa if you plan to return to Australia before a decision is made on your application.

Health exams

Health examination results are generally valid for 12 months. If your previous health clearance for subclass 188 visa is more than 12 months old, you will need to undertake new health examinations.

Do not undertake new health examinations until we ask you to.

Biometrics

We might ask for biometrics (fingerprints and photo). We will let you know if you need to provide them.

Stay lawful

If you are in Australia, make sure you stay lawful by holding a valid visa while we process your application.

When you applied for this visa, if you were in Australia, you were granted a Bridging visa A (BVA). If your current visa expires before we decide on your application, the BVA will start.

You can stay in Australia on the BVA while we process your new visa application. However, if you intend to leave Australia and return while holding a BVA, you will need to apply to our office for a Bridging Visa B (BVB) or make alternative visa arrangements to return, as your BVA ceases when you leave Australia.”

Do not cancel your current visa. If you do, you will:

  • be staying in Australia unlawfully
  • not be eligible for a Bridging visa A

Pay the second instalment

If you need to pay a second instalment, we will send you an invoice after you have met all other requirements for the visa. Pay the invoice after you get it.

Adding family members

You can add members of the family unit to your application after you apply but before we decide on your visa

Complete Form 1436 Adding an additional applicant after lodgement and

  • send it to the email address we gave you when you sent your application
  • include evidence of the child's relationship to you
  • include other supporting documents for your child, such as identity documents
  • pay the additional application charge

5Visa outcome

You can be in or outside Australia when you apply for the visa and when we decide on your application.

We will let you know in writing our decision about your visa application. If we grant you the visa, we will tell you:

  • your visa grant number
  • the date your visa starts
  • your visa conditions

Keep a copy of this with you when in Australia.

If we refuse your visa application we will let you know why we refused and whether you have a right to a review of the decision.

We will not refund the application charge if we refuse your application.

This is a permanent visa. It lets you stay in Australia permanently.

Travel to and from Australia for 5 years

You can travel to and from Australia as many times as you want for 5 years from the date we grant this visa. This is as long as the travel facility on this visa remains valid.

If you want to travel after the initial 5-year travel facility:

  • you will need to apply for and be granted a Resident Return (RRV) so that you can re-enter Australia as a permanent resident
  • you might also want to consider Australian citizenship. If you become an Australian citizen, you don't require a visa to enter Australia. Bringing family

You can't add a family member to your application after we have granted the visa.

  • we grant the visa, if you were in Australia
