This provisional visa is for people with business skills. It lets you operate a new or existing business in Australia. This stream closed to new applications on 31 July 2024.

How long you can stay

This is a provisional visa. You can stay in Australia for up to 5 years if you were invited to apply for this visa on or after 1 July 2021.

If you applied after 1 July 2015, and were invited to apply for this visa before 1 July 2021, you can stay in Australia for up to 4 years and 3 months.

If you applied before 1 July 2015, you can stay up to 4 years.

The visa is granted with multiple entries. You can leave and re-enter Australia as many times as you want while the visa is valid.

The visa starts on the date it is granted.

Stay longer

This is a provisional visa. You must apply for a new visa if you want to stay longer. Once you have this visa, you can apply for permanent residence through the Business Innovation and Investment (Permanent) visa (subclass 888) in the Business Innovation stream if certain requirements are met. If you need more time to apply for permanent residence, you can apply for a new Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation Extension stream. If granted, you will be able to travel to, enter and remain in Australia for up to 7 years after the date of the grant of the original Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation stream.

Include family

You can add your dependent child or children to your application at any time before we decide on your application. They will need to meet our health and character (if applicable) requirements.

The spouse or de facto partner of the main applicant who did not make a combined application at the initial lodgement of the subclass 188 visa, can make a subsequent entrant application. A subclass 188 visa can only be granted to a subsequent entrant after the main applicant’s subclass 188 visa is granted.

In order for the primary applicant to be granted the visa, family members who are not coming to Australia must meet our character requirements, and might have to meet our health requirements.

Cost

From AUD12,505.00 for the main applicant (concessions apply in limited circumstances).

Any applicant 18 years old or older who has less than functional English must also pay an extra charge. This charge is the second instalment charge. Pay it only when we ask you to. We will refund the charge if we do not grant you the visa.

The second instalment charges are:

main applicant: AUD9795
family members: AUD4890

Cost concession for eligible Pacific Island and Timor-Leste visa applicants

From 1 July 2026, a lower visa cost applies to eligible Pacific Island and Timor-Leste citizens who lodge a valid visa application.

We will charge eligible applicants the lower visa application cost during the application process in ImmiAccount. We will recognise eligible applicants by the valid passport from the specified countries used in the application when they apply.

Family members are also eligible for the lower visa cost. We base this on the passport of the primary applicant (or visa holder who satisfies the primary visa criteria).

The primary applicant must hold a valid passport issued by one of the following countries:

Apply from

You can be in or outside Australia when you apply for the visa and when we decide on your application, but not in immigration clearance.

Processing times

Your application might take longer to process if:

you do not complete the form correctly
you do not include all the documents we need or we need more information from you
it takes us time to verify your information

We can't process your application if you do not pay the correct visa application charge. We will notify you if this is the case and if necessary return your application.

Your obligations

You and your family members who are part of your application must comply with all visa conditions and Australian laws.

You must also meet certain business obligations and obey Australian workplace laws.

Meet your business obligations

While the holder of this visa, you must:

have a substantial ownership interest in a business in Australia
take part in its day-to-day management, at a senior level

In the business, you must do at least one of these things:

add to commercial activity and competitiveness within the Australian economy
develop business links with international markets
employ people in Australia
export Australian goods
introduce new or improved technology, or
produce goods or services that Australia would otherwise import

Follow Australian workplace laws

All workers in Australia (including visa holders) have rights and protections at work. Pay rates and workplace conditions are set by Australian law.

You must meet workplace laws when operating your business in Australia. The Pay and Conditions Tool (PACT) can help you with:

Adequate health insurance

We recommend you take out health insurance to cover any unforeseen medical treatment you might need in Australia. You are personally liable for all your healthcare costs while you are in Australia. Insurance can help limit your financial liability.

You can travel outside Australia and return as many times as you want while the visa is valid.

The time you spend outside Australia does not extend the visa.

Receive an invitation to apply

First, you must submit an Expression of Interest (EOI). If an Australian State or Territory government agency accepts your EOI and nominates you, we will invite you to apply for this visa.

Be nominated

You must be nominated by an Australian State or Territory government agency, before being invited to apply for this visa.

The State or Territory government agency that nominates you must not withdraw their nomination after you apply, or we will be unable to grant you a visa.

Have business ownership

For 2 out of 4 fiscal years immediately before you receive an invitation to apply, you must have had an ownership stake in 1 or 2 businesses that had at least:

AUD500,000 turnover in each of those 2 years if you were invited to apply before 1 July 2021
AUD750,000 turnover in each of those 2 years if you were invited to apply on or after 1 July 2021

Whether you have 1 or 2 businesses, you must own at least:

51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year
30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or
10%, of the total value of the business if the business is operated by a publicly listed company

If your business provides professional, technical or trade services, you must have spent less than half your time providing those services, rather than general management of the business.

Own personal and business assets

When you are invited to apply for this visa, you, your partner, or you and your partner combined must have total net business and personal assets of at least:

AUD1.25 million if you were invited to apply on or after 1 July 2021.
AUD800,000 if you were invited to apply before 1 July 2021

Your funds must be available to transfer to Australia within 2 years of us granting the visa.

Score at least 65 on the points test

You must score at least 65 points on the points test.

You can get points for many reasons, including your:

age
English language ability
qualifications
business experience
net personal and business assets
business turnover
innovation
special endorsement

Have a successful business career

You must have a successful business career and a genuine desire to continuously own and manage a business in Australia.

Be under 55

You will not receive an invitation if you are aged 55 or older at the time of the invitation to apply for the visa. If you are older, a State or Territory might invite you to apply for this visa if your business will be of exceptional economic benefit.

Not have a history of involvement in unacceptable activities

You and your partner must have had no history of involvement in business or investment activities that are of a nature that is not generally acceptable in Australia.

Have functional English

All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge.

Meet our health requirement

You and any family members who apply for the visa with you must meet our health requirement.

Family members who are not coming to Australia might also meet our health requirement.

Meet our character requirement

You and family members aged 16 years and over who apply for the visa with you must meet our character requirement.

Family members who are not coming to Australia must also have to meet our meet our character requirement.

Sign the Australian values statement

If you and your family members who have applied for the visa are 18 years of age or older at the time of application, you and your family members must:

have read, or had explained to you, the Life in Australia book
sign an Australian Values Statement that confirms you will respect the Australian way of life and obey Australian laws

Have no debt to the Australian Government

If you or any family members owe the Australian Government money, you or they must have paid it back or have an approved arrangement in place to pay it back.

Not have had a visa cancelled or a previous application refused

We will consider your immigration history when we make a decision on your application, which means you might not be eligible for this visa if you have had a visa cancelled or refused.

1Before you apply

You must give us an Expression of Interest (EOI), be nominated by a State or Territory, and then be invited to apply.

Help with your EOI

Before you submit your EOI

You must submit an expression of interest (EOI) to let us know you want to apply for this visa.

Your EOI tells us about your skills, qualifications and business experience. It lets us know which states and territories you would like to operate a business in. If you are eligible and a State or Territory government nominates you, we might then invite you to apply for the visa.

Check your eligibility

Check that you meet all other eligibility criteria for the visa.

Gather your documents

If you receive an invitation to apply for the visa after you submit your EOI, you will need to provide documents that:

prove all of the claims you make in your EOI
support other eligibility criteria for the visa

You should have all these documents before you submit your EOI.

Check your points

You must score at least 65 points on our points test to be eligible for this visa. If you can't score 65 points, you will not be considered for an invitation.

If we invite you to apply for the visa, you must prove the claims you make in your EOI.

Submit an EOI

Submit your EOI via Skillselect.

You can submit it from within or outside Australia.

Your EOI is not a visa application. There is no charge for submitting an EOI.

Select the Business Innovation and Investment (Provisional) visa (subclass 188).

You will receive an email confirming your EOI has been submitted.

After you submit your EOI

SkillSelect will estimate your points score. If you score is at least 65 points, your EOI will be visible to State and Territory governments. If you have skills they need, a State or Territory government agency might nominate you for the visa.

If you get a nomination, you will get an invitation to apply for this visa

Stay lawful

An EOI is not a visa application. Submitting an EOI does not mean you will get a bridging visa.

If your current visa is about to expire, you must apply for another visa to remain in Australia lawfully.

After you submit your EOI

You can change your EOI in SkillSelect if:

you want to apply for a different skilled visa
your circumstances change

You must be able to meet the minimum score of 65 points.

SkillSelect will update your points score when you make changes to your EOI. You can change your EOI at any time before we invite you to apply for a visa.

You can't make changes to your EOI after we invite you to apply for a visa.

Receive an invitation to apply for visa

You could receive an invitation any time within 2 years of submitting your EOI. If you are invited to apply for the visa, you will receive an email from SkillSelect. Receiving an invitation does not mean you will be granted the visa.

If you are invited, you have 60 calendar days to apply for the visa. This time will not be extended.

You must demonstrate that you can score a minimum of 65 points and satisfy all other eligibility criteria. If you can't meet the points score and all other eligibility criteria, we will not grant you the visa.

If you do not apply for the visa after two invitations, your EOI will be removed from SkillSelect.

If you can't meet the points score or other eligibility criteria

If you can't show that you can meet the points score and satisfy all other eligibility criteria, you should not apply for the visa until you can. If you want to update your EOI to better reflect your points score, you can do that after the 60-day invitation period.

If this is your first invitation, you might be sent a second invitation after the 60-day invitation period.

If this is your second invitation, you will have to submit another EOI if you still want the visa.

If you do not receive an invitation

If you are not invited to apply within 2 years of submitting your EOI, your EOI will expire. We will send you an email when your EOI is about to expire.

You will need to submit a new EOI if you still want the visa.

You will not receive an invitation if you turn 55, unless the nominating State or Territory government agency has determined an exceptional economic benefit to the State or Territory in which the agency is located.

Make sure passports are up-to-date

You and your family members who are applying for this visa, will need valid passports. If you plan to get a new passport, do this before applying.

Get help with your application

Only some people can help you with your application. If you appoint someone to give you immigration assistance they must be:

You can appoint anyone to receive documents on your behalf relating to your visa matter.

2Gather your documents

You will need to prove your identity, and provide documents about your business and assets. You also need to provide documents about family members applying with you.

Applying from China, Macau, Hong Kong or Taiwan

If you are applying from the People’s Republic of China, Macau (SAR), Hong Kong (SAR) or Taiwan use the document checklist from the Australian Consulate General Hong Kong.

Provide accurate information

You are obliged to prove your identity and provide true information with your application. See what happens if you can't prove your identity or do not provide true information.

Identity documents

You and family members who apply for the visa with you, must provide:

Colour copies of the pages of your current passport showing photo, personal details, and passport issue and expiry dates.

Also provide:

a national identity card, if you have one
proof of change of name, if applicable

Documents that prove a change of name include:

a marriage or divorce certificate
change of name documents from an Australian Registry of Births, Deaths and Marriages, or the relevant overseas authority
documents that show other names you have been known by

Business and assets documents

You must provide documents about your business and your net assets. These documents are to prove that your business is eligible for this visa. With your application, provide:

Business documents

With your application, give us:

An overview of your business career and intentions in Australia

This can include:

a statement outlining your intended business or investment activities
a description of your research or study in relevant sectors in Australia
a description of your business's activities in Australia, and the period of ownership, if applicable

Evidence of the net value of your business and personal assets

This can include:

For cash assets: bank statements or similar records of ownership.
For real estate assets: evidence of ownership. This could be a certificate of title, title deed, valuation certificate by an accredited property valuer, or mortgage certificate.
For personal loans: loan agreements showing the borrower and lender, loan statements showing the amount borrowed and repayment schedule.
For stocks and bonds: share or debentures certificates, fixed interest securities, ownership and market value of claimed marketable securities such as bonds.
For business assets: financial statements which include a balance sheet, profit and loss statement and notes to the accounts. They should be dated as at the fiscal year ending immediately before your date of invitation and must be completed to International Accounting Standards

If you want to include assets held by a trust, you must include a copy of the trust deed.

Evidence of business ownership at the time you are invited to apply

This can include:

full company extract or certificate of incorporation
shareholder certificate lodged with the Company Registrar, showing your share of capital annual return of the business
memorandum and articles of association
certificate of business registration, business licence or business names extract for the business
franchise agreement, company registrar, or share transfer documents
partnership agreements between all partners

If your business is a trust, provide full trust deed and amendments (including the names of all trustees and beneficiaries at the time the trust was formed).

Evidence you managed the business

Provide evidence that you maintained direct and continuous involvement in management of the business from day to day and in making decisions affecting the overall direction and performance of the business for 2 of the 4 fiscal years before we invited you to apply.

The evidence needs to show your involvement in decisions about the management of the business. It must show you are responsible for such areas as:

strategic management
recruitment
price structure
profitability
expenditure

Evidence of business registration

Provide your business registration certificate or licence for your main business.

Evidence of your ownership or share of ownership of the main business

This can include:

evidence of purchase in the form of share registers, company registers, or share transfer documents
historical company extracts in the form of annual returns of directors and shareholders
partnership, trust or franchise agreements

Financial statements

Provide a full set of financial statements for your business. These must be for:

2 fiscal years immediately before we invited you to apply.
any other fiscal year in the 4 years immediately before we invited you to apply, if you are claiming points for turnover in those years

An independent accountant must prepare the statements to International Accounting Standards. They must include a balance sheet, profit and loss statement and notes to the accounts.

Organisational chart and business premises

Provide:

a one-page organisational chart showing your position in the business, staff attribution, management reporting lines and functional responsibilities
photos of business premises and business activities (maximum 6 photos)

Information about losses or insolvency

If applicable, provide:

details if any of your businesses has operated at a loss
evidence if any of your businesses is or has been subject to insolvency, receivership or liquidation
evidence of bankruptcy of any of your businesses

Net assets

Evidence of assets of:

AUD1.25 million if you were invited to apply on or after 1 July 2021
AUD800,000 if you were invited to apply before 1 July 2021

Provide evidence that you, your partner, or you and your partner combined hold required total net business and personal assets. You must have acquired these assets legally. You must be able to transfer them to Australia within 2 years after we grant the visa.

You will be required to nominate a specific date within 3 months immediately before we invited you to apply.

Summary statement of assets and liabilities

Provide Form 1139A Statement of Assets and Liabilities Position.

Evidence of asset ownership and value

Provide evidence of your ownership of each asset, its value, and any liabilities against it as at the date you nominated.

Provide:

for business assets: a full set of financial statements dated as at the fiscal year ending immediately before you were invited to apply. An independent account must prepare these to International Accounting Standards. They must include a balance sheet, profit and loss statement and notes to the accounts.
for cash assets: bank statements showing the account holders name and balance as at the date you nominated
for real estate assets: title deeds, valuation certificates by an accredited property valuer and mortgage statements showing outstanding balances as at the date you nominated.
for personal or business loans: banks statements showing the account holders name and balance owed as the date you nominated
for stocks and bonds: statements showing the account holders name and balance as at date you nominated
for assets held by trust: the trust deed including all schedules

Label each document so it lines up clearly with your Statement of Assets and Liabilities Position

Label each document so that it clearly identifies the relevant asset or liability.

Cross- reference the asset or liability to the appropriate item in the Statement of Assets and Liabilities Position. This can be found on Form 1139A Statement of Assets and Liabilities Position.

Points Test documents

Provide documents only for items you want points for in the Points Test. Check what you can get points for.

English language ability

To be awarded points for English language ability you must demonstrate that you have either vocational English or proficient English.

Qualifications

Provide a certified copy of the trade qualification, diploma or bachelor degree to claim points.

Net assets

Provide evidence of ownership of assets as at the 2 fiscal years prior to when we invited you to apply for the visa. Use Form 1139A Statement of Assets and Liabilities Position.

Business turnover

Provide a full set of financial statements for the business:

for 2 of the 4 fiscal years before we invited you to apply for this visa
prepared by an independent accountant to International Accounting Standards
which includes a balance sheet, profit and loss statement and notes to the accounts

Turnover claims must be further supported by submitted VAT or Income Tax Returns for the business.

Business experience

Provide evidence that you have held one or more main business for:

at least 4 years in the 5 years immediately before we invited you to apply for this visa, or
at least 7 years in the 8 years immediately before we invited you to apply

Innovation

Registered patent or design

For a registered patent or design, provide evidence that proves that you own it.

The relevant national or regional intellectual property administration office must issue this evidence. It must include enough information that we can assess whether your ownership meets the points requirement.

Also provide a statement outlining how the registered patent or registered design is relevant to your main business.

This statement must also show how it is applied in the day-to-day activities of the business. You must be able to provide evidence to support any claims made in the statement if we ask you to.

Registered trademark

For a registered trademark, provide evidence that proves ownership of the trademark.

The relevant national or regional intellectual property administration office must issue this documentation. It must include enough information that we can assess whether your ownership meets the points requirement.

Also provide a statement outlining how the trademark is relevant to your main business. This statement must also show how it is applied in the day-to-day activities of the business. You must be able to provide evidence to support any claims made in the statement if we ask you to.

Joint venture agreement

For a joint venture agreement, provide a copy of the agreement showing:

the details of the respective rights and obligations of the parties to the joint venture
that you entered the agreement at least one year before we invited you to apply for this visa
that your business is a party to the joint venture

Also provide a statement outlining:

how you used your skills at a senior level in the day-to-day management of the joint venture business
evidence to support the claims made in the statement
that the joint venture was operated in accordance with the joint venture agreement

Export trade

For export trade, provide:

Evidence that at least 50% of the turnover of your main business related to export trade. This must be the case for at least 2 of the 4 fiscal years before we invited you to apply for this visa. You could provide:

monthly or annual tax returns showing the cumulative export sales of the main business for the year
customs declarations
the underlying source documents in relation to the export transactions

We might ask you to provide a special-purpose report prepared by a qualified accountant attesting to your claim.

Gazelle business

For a gazelle business, provide:

evidence that your main business was registered no more than 5 years before we invited you to apply for this visa such as a business licence or company extracts
the financial statements of the main business, with supporting tax documents, to show an average annualised growth in turnover greater than 20% per year over 3 consecutive fiscal years

Also provide evidence that you have had 10 or more full-time employees for at least one fiscal year. This must be the same consecutive 3-year period claimed for growth in turnover. You could provide taxation records, insurance or superannuation documents or similar business records identifying each employee by name.

Receipt of grant or venture capital funding

To show receipt of grant or venture capital funding, provide:

certified copies of a grant letter and bank records to show the transfer of a government grant of at least AUD10,000 from the government to you or your main business
a copy of the final contract between you and the venture capital firm and evidence of the receipt of the venture capital funding of at least AUD100,000
evidence that you received funding from either the government grant or a venture capital firm within the 4 years before we invited you to apply for this visa

English language documents

Provide proof you have at least functional English.

All applicants aged 18 years and older at the time of application who can't provide evidence of having at least functional English must pay a second instalment of the visa application charge.

If you and any family member applying with you have less than functional English, provide a statement indicating your intention to pay the second visa application charge for each person with less than functional English.

We will advise you when to pay this.

Health documents

You do not need to provide health documents. The doctor will send them to us.

Character documents

You and family members aged 16 years and over who apply for the visa with you, provide:

Form 80 Personal particulars for assessment including character assessment
an overseas police certificate from every country, including your home country, where you spent a total of 12 months or more in the last 10 years since you turned 16
military service records or discharge papers if you served in the armed forces of any country

Tell us you are getting help

To nominate someone to:

receive your correspondence, use Form 956A Appointment or withdrawal of an authorised recipient
provide immigration assistance, use Form 956 Appointment of a registered migration agent, legal practitioner or exempt person.

Upload your written notification or your forms to ImmiAccount.

Partner documents

Provide your partner's:

identity documents
character documents
documents about other relationships, if applicable

Provide either:

your current marriage certificate or
enough documents to prove you have been in a de facto relationship with your partner for at least 12 months before you apply

Documents that prove your de facto relationship include:

joint bank account statements
billing accounts in joint names
joint leases or mortgages
documents that show your partner has lived at the same address as you

Dependents under 18 documents

For every dependant 18 years old or younger who is applying with you, provide:

copies of birth certificates or the family book showing the names of both parents of all your dependent children
copies of the adoption paper, if applicable.

Parental responsibility documents

You must get consent for any applicant under 18 years of age to migrate to Australia from anyone who:

has a legal right to decide where the child lives and
is not coming to Australia with the child

They must complete either:

Form 1229 Consent form to grant an Australian visa to a child under the age of 18 years
a statutory declaration giving their consent for the child to visit Australia on this visa

Alternatively, you can show us:

an Australian court order that allows your child to migrate to Australia, or
that the laws of your home country allow them to migrate

Include:

an identity document that shows the signature and photo of the person who completed the form or declaration, such as a passport or driver’s licence
adoption papers or other court documents if applicable

Note: If your child is likely to turn 18 while your application is being processed, you will need to provide evidence they are dependent on you. See the section 'Dependants over 18 documents' below for further information. A child who turns 18 while your application is being processed and who is not dependent on you cannot satisfy the criteria for this visa.

Dependents over 18 documents

To include your child who is over 18 in your visa application, they must be:

over 18 years of age but not yet turned 23, and dependent on you or your partner, or
over 23 years of age, unable to earn a living to support themselves due to physical or cognitive limitations and dependent on you or your partner

Provide:

identity documents
documents about their other relationships, if applicable
character documents

If your child is likely to turn 23 while your application is being processed, you will need to provide evidence they are dependent on you due to disability.

Proof of dependency

You must demonstrate that the child is dependent on you, by providing:

proof of your relationship with the dependant such as a birth certificate or adoption papers
a completed Form 47a Details of a child or other dependent family member aged 18 years or over
if the child is aged 23 or is likely to turn 23 while your application is being processed, you must also provide a report from a qualified medical practitioner that states they are dependent on you or your partner due to the total or partial loss of their bodily or mental functions

You must also prove this person has been financially dependent on you for at least 12 months before you apply. You could provide:

proof they live with you
their tax records
proof they are currently studying
proof of payments made by you to them or on their behalf

Note: A child who turns 23 while your application is being processed and who does not meet these requirements cannot satisfy the criteria for this visa.

Prepare your documents

Translate

Have all non-English documents translated into English.

Provide original and translated documents in your application.

Translators in Australia must be accredited by the National Accreditation Authority for Translators and Interpreters.

Translators outside Australia do not have to be accredited. But on each translation, they must include their:

full name
address and telephone number
qualifications and experience in the language they are translating

These details must be in English.

Note: You do not need to have any documents certified

Scan or photograph

Scan or photograph all documents (English and non-English) in colour.

The scans and photos must be clear.

If a document is more than one page, save it all as one file.

3Apply for the visa

Apply for this visa online in ImmiAccount. You must be invited to apply. Your invitation letter contains instructions on how to lodge your application.

For all applications lodged from 13 November 2021, applicants should upload supporting documentation to ImmiAccount when lodging a subclass 188 Business Innovation and Investment visa application in all streams.

Uploading all documents to ImmiAccount will ensure efficient processing and help to reduce processing times. Please utilise naming conventions provided when uploading supporting documents. Where naming conventions are unavailable for a particular document/s, please ensure that a proper heading is provided to the attached document/s.

Provide accurate information

You are obliged to prove your identity and provide true information with your application. See what happens if you cannot prove your identity or do not provide true information.

Create an account or sign in to ImmiAccount
Pay the application charge.
Note the transaction reference number (TRN)

ImmiAccount will tell you the charge. We will not process your application until you pay the correct charge.

Send your documents

For applications lodged prior to 13 November 2021

After you submit your application online, send us your documents and other forms.

If you are applying from the People’s Republic of China, Macau (SAR), Hong Kong (SAR) or Taiwan use the document checklist from the Australian Consulate General Hong Kong.

If you live elsewhere, send your supporting documents via email to the mailbox address specified in the Acknowledgement of Application Received letter. You will receive this letter after you lodge your application via ImmiAccount.

For applications lodged after 13 November 2021

Status updates

We cannot provide updates on applications. You will be contacted if additional information is required. Please wait for us to contact you.

Travel after you apply

You do not have to tell us if you want to travel outside Australia while we process your application. This is because you can be outside Australia when we make a decision.

But if you leave Australia, you must make sure you have a valid visa if you plan to return to Australia before a decision is made on your application.

If you did not have health examinations before you applied, we will let you know if you need them.

Biometrics

We might ask for biometrics (fingerprints and photo). We will let you know if you need to provide them.

Provide more information

If you didn't send us all documents when you applied, send them as soon as you can.

Applying from China, Macau, Hong Kong or Taiwan

If you are applying from the People’s Republic of China, Macau (SAR), Hong Kong (SAR) or Taiwan use the document checklist from the Australian Consulate General Hong Kong.

Stay lawful

If you are in Australia, make sure you stay lawful by holding a valid visa while we process your application.

When you applied for this visa, if you were in Australia, you were granted a Bridging visa A (BVA). If your current visa expires before we decide on your application, the BVA will start.

You can stay in Australia on the BVA while we process your new visa application. However, if you intend to leave Australia and return while holding a BVA, you will need to apply to our office for a Bridging Visa B (BVB) or make alternative visa arrangements to return, as your BVA ceases when you leave Australia.”

Do not cancel your current visa. If you do, you will:

be staying in Australia unlawfully
not be eligible for a Bridging visa A

Pay the second instalment

If you need to pay a second instalment, we will send you an invoice after you have met all other requirements for the visa. Pay the invoice after you get it.

You must pay the instalment before we will grant the visa.

Adding family members

your dependent child or children to your application at any time before we decide on your application. They will need to meet our health and character (if applicable) requirements.

Complete Form 1436 Adding an additional applicant after lodgement and

send it to the email address we gave you when you sent your application
include evidence of the child's relationship to you
include other supporting documents for your child, such as identity documents
pay the additional application charge

5Visa outcome

We will let you know in writing our decision about your visa application. If we grant you the visa, we will tell you:

your visa grant number
the date your visa starts
your visa conditions

Keep a copy of this with you when in Australia.

If we refuse your visa we will tell you why we refused and whether you have a right to a review of the decision.

We will not refund the application charge if we refuse your application.

What you can do when you have this visa

This is not a permanent visa. With this visa you can:

carry out business and investment activity in Australia
travel to, enter and remain in Australia for up to 5 years
bring eligible members of your family with you
apply for a permanent Business Innovation and Investment (Permanent) visa (subclass 888) Business Innovation stream, if certain requirements are met

What you must do on this visa

You and your family members must comply with all visa conditions and obey Australian laws. See your conditions in VEVO or your visa grant letter.

You also must meet certain business obligations and comply with Australian workplace laws.

Meet your business obligations

You must genuinely have a realistic commitment to:

maintain substantial ownership interest in a business in Australia
participate in the day-to-day management and decision-making of that business

In the business, you must do at least one of these things:

develop business links with international markets
employ people in Australia
export Australian goods
produce goods or services that would otherwise be imported
introduce new or improved technology, or
add to commercial activity and competitiveness within the Australian economy

During your stay, we might survey you about your business activities in Australia.

Follow Australian workplace laws

All workers in Australia (including visa holders) have rights and protections at work. Pay rates and workplace conditions are set by Australian law.

If you operate a business in Australia, you must comply with workplace laws. The Pay and Conditions Tool (PACT) can help you with pay rates, shift calculations, leave arrangements and notice and redundancy entitlements.

This is a provisional visa. You can stay in Australia for up to 5 years.

The visa starts on the date we grant it.

Staying longer

This is a provisional visa. You must apply for a new visa if you want to stay longer. Once you have this visa, you can apply for permanent residence if certain requirements are met. Explore your visa options.

Apply for permanent residence

Once you have the provisional visa, you can apply for the Business Innovation and Investment (Permanent) visa (subclass 888) Business Innovation stream if certain requirements are met.

Extend your stay in Australia

If you need more time to apply for permanent residence, you can apply for a Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation Extension stream to extend your stay in Australia.

If we grant this visa, it will be valid for up to 7 years after the date of the grant of the original provisional visa held at the time of application. The extra time gives you time to qualify for a Business Innovation and Investment (Permanent) visa (subclass 888) in the Business Innovation stream.

Travelling on your visa

This is a multiple entry visa. You can travel outside Australia and return as many times as you want while the visa is valid.

The time you spend outside Australia does not extend the visa.

Bringing family

After you are granted this visa, if members of your family want to apply for the same visa, they must submit a separate online application. Any additional family members are called 'subsequent entrants'.

Newborn and dependent child or children can be added to your 188 visa application before we decide on your application. However, your spouse or de-facto partner, who did not make a combined application with you at the initial lodgement of your application, can make a subsequent entrant application. A subclass 188 visa can only be granted to a subsequent entrant after the main applicant’s subclass 188 visa is granted.
