Training visa

Visit Australia to do workplace-based training to improve your skills for your:

• current occupation
• area of tertiary study
• field of expertise.

You can also use this visa to complete a professional development training program. This visa is not for ongoing work in Australia.

The Training visa is not intended to be used to fill workforce shortages. All work undertaken in Australia must be paid. You can find information on required minimum wages at the Fair Work Ombudsman website.

We must have approved your sponsor as a temporary activities sponsor.

Unless your sponsor is an Australian Commonwealth Government agency, they must also submit a nomination for you. We must approve this nomination before you can apply for your visa.

Nomination is the stage where the sponsor gives us details about:

• the intended trainee they want to nominate – the nominee, you
• details of the training, including the purpose or type of training
• how and where the training will happen.

If your sponsor is an Australian Commonwealth Government agency you do not need a nomination. We must have approved the agency’s sponsorship application before you can apply for your visa.

Nomination requirements are different depending on the purpose or type of training.

There are 3 types of occupational training covered by this visa:

• Occupational training required for registration
• Occupational training to improve skills in an eligible occupation
• Occupational training for capacity building overseas. This includes overseas qualification, government support or professional development.

Changing sponsors

If you decide to train with another organisation while you are in Australia, that organisation needs to sponsor you. They must also submit a new nomination for you.

When we approve the new nomination you can do occupational training with that organisation for the time left on your visa.

You do not have to apply for a new visa if you continue to do the training program we approved your visa for. If your training program changes, you will need to apply for a new visa when we approve the new nomination.

Changing activity/occupation with the same sponsor

If you stay with the same sponsor but change your training program, your sponsor must submit a new nomination for you about the new training program. If we approve the nomination, you will then need to submit a new visa application.

If your sponsor ends your training, you must tell us. You may try to find another organisation to sponsor you.

Be mindful of scams

Beware of visa scams. Make sure you know the conditions of the visa that you apply for, even if someone else submits the application for you. For more information see Visa scams.

This is a temporary visa. We might grant you a visa stay in Australia for up to 2 years.

You can leave and re-enter Australia on the visa while it is valid.

You can't stay in Australia longer by extending this visa.

Family members who apply for the visa with you must also meet our health and character requirements.

If you apply for this visa from outside Australia, family members who are not coming to Australia might also have to meet our health requirements.

Subsequent entrants

If we grant you the visa, your family members might be able to apply to join you in Australia later as a subsequent entrant.

They can do this using the Temporary Work and Activity Visa (Subsequent Entrant) (403,407,408) form in ImmiAccount.

Family members applying subsequently should :

• be listed on the nomination form if their sponsor is not a Commonwealth Government Agency, and
• provide a letter from the sponsor of the primary applicant confirming the sponsor has agreed to sponsor them

The visa costs from AUD535.00 for the main applicant (concessions apply in limited circumstances).

There is also a charge for each family member who applies for the visa with you.

You might also have to pay other costs for health checks, police certificates and biometrics.

Cost concession

A lower visa cost applies to eligible Pacific Island and Timor-Leste citizens who lodge a valid Training visa application.

We will charge eligible applicants the lower visa application cost during the application process in ImmiAccount. We will recognise eligible applicants by the valid passport from the specified countries used in the application when they apply.

Family members are also eligible for the lower visa cost. We base this on the passport of the primary applicant (or visa holder who satisfies the primary visa criteria).

Pacific Island and Timor-Leste citizens primary applicants must hold a valid passport issued by one of the following countries:

• Federated States of Micronesia
• Fiji
• Kiribati
• Nauru
• Palau
• Papua New Guinea
• Republic of the Marshall Islands
• Samoa
• Solomon Islands
• Timor-Leste
• Tonga
• Tuvalu
• Vanuatu

You can be in or outside Australia when you apply for the visa and when we decide on your application.

Your application might take longer to process if:

• you do not fill it in correctly
• you do not include all the documents we need or we need more information from you
• we have to verify your information

We can't process your application if you do not pay the correct visa application charge. We will notify you if this is the case and if necessary return your application.

You and your family members must obey all Australian laws.

You can travel outside Australia and return as many times as you want while the visa is valid.

The time you spend outside Australia does not extend the visa.

We will digitally link your visa to your passport. You will not get a label in your passport.

You will need to be able to financially support yourself while in Australia. You will need to be able to financially support accompanying family members.

If you want to apply for a new Training visa (subclass 407) you will need continuing sponsorship. You may have to provide an explanation of why you were unable to complete the training within the initial training period.

Your sponsor must be approved as a temporary activities sponsor.

Your sponsor must have nominated you for a program of occupational training unless they are an Australian Commonwealth Government agency.

We must approve your nomination before you apply for this visa.

Usually, you must be 18 years old or older at the time we decide your visa application.

If you are applying in Australia, you must currently hold a valid temporary substantive visa that is not a:

• a Subclass 403 (Temporary Work (International Relations) visa in the Domestic Worker (Diplomatic or Consular stream) or
• a Subclass 771 (Transit) visa or
• a Special Purpose visa

If you are in Australia and do not hold a substantive visa, your last substantive visa must not have been one of the above visas and your application must be made within 28 days:

• after the last substantive visa you held ceased to be in effect or
• after the day you were notified of the Administrative Appeal Tribnual's decision to set aside and substitute the decision to cancel your substantive visa, or the Minister's decision not to revoke the cancellation of your substantive visa.

You and any family members who apply for the visa with you must meet our health requirement.

You and family members aged 16 years and over who apply for the visa with you must meet our character requirement.

We might also ask that other family members meet the requirement.

You are personally liable for all your healthcare costs while you are in Australia. Medical insurance helps limit your financial liability. You must maintain adequate health cover for the whole of your stay if you are granted this visa. Your insurance should cover you for medically necessary treatment, including transport.

Reciprocal healthcare agreements

You must only intend to:

• stay temporarily in Australia
• do the things you are allowed to do on this visa

You must have substantially complied with the conditions of the last substantive or subsequent bridging visa that you held.

You must have functional English.

If you are 18 years of age or older, you must:

• have read, or had explained to you, the Life in Australia booklet and
• sign an Australian Values Statement that confirms you will respect the Australian way of life and obey Australian laws

If you or any family members (including those who don't apply for the visa with you) owe the Australian government money, you or they must have paid it back or arranged to pay it back.

We will consider your immigration history when we make a decision on your application, which means you might not be eligible for this visa if you have had a visa cancelled or refused.

We might not grant this visa if it is not in the best interests of an applicant under 18.

If we have granted you a Training (subclass 407) visa, you may want to consider withdrawing any other undecided visa applications you have lodged with us.

We will continue to progress any undecided visa applications. If they meet the requirements it may result in your current visa ceasing. It may also affect your eligibility for government benefits such as Centrelink or Medicare.

Migrant worker protections and Australian workplace laws

Australian laws under the Fair Work Act give migrant workers the same rights and protections as all other employees, regardless of their migration status.

It is illegal for your boss to exploit you at work, even if you are doing unpaid training on a visa. All work undertaken on the Training visa must be paid in line with minimum wages. Family members

Family members who are granted the same visa with you can only work up to 40 hours every two weeks in Australia.

To participate in the Training visa program, organisations must become an approved temporary activities sponsor and nominate a trainee.

Nomination requirements are different depending on the purpose or type of training.

Nomination is the stage where the sponsor gives us details about the:

• nominee (intended trainee)
• purpose or type of training
• how and where the training will take place.

The nominee can apply for the visa only after we have approved the nomination.

There are 3 types of occupational training covered by this visa:

• Occupational training required for registration
• Occupational training to improve skills in an eligible occupation
• Occupational training for capacity building overseas. This includes overseas qualification, government support or professional development.

AUD420.00 to sponsor

AUD170.00 to nominate

We will let you know how long your sponsorship will last when we approve it. Usually sponsorship lasts for 5 years starting from the date of approval.

You must meet all of your sponsorship obligations as a temporary activities sponsor. This includes providing the training program that you have nominated.

You are responsible for meeting these obligations even if you appoint someone, such as a migration agent, to act for you.

It is illegal to exploit migrant workers including when someone is doing unpaid workplace-based occupational training with your business. If you exploit them, you could be fined or jailed. Learn more and watch the video at Migrant worker protections.

You must ensure any workplace-based occupational training arrangements, including unpaid arrangements, comply with Australian workplace laws. For free advice and assistance about your obligations, you can visit the Fair Work Ombudsman’s website at www.fairwork.gov.au.

You can withdraw your sponsorship at any time before we decide on the visa application.

You must make your request in writing and include:

• your full name
• your date of birth
• the file reference number or Client ID.

Your application may take longer to process if:

• you do not complete it correctly
• you do not include all the documents we need
• we need more information from you
• it takes us time to verify your information
• you do not pay the correct fee

You must be an approved temporary activities sponsor to sponsor a person for this visa.

You must offer the nominated program as a genuine training opportunity.

Nomination requirements are different depending on the purpose or type of training.

There are 3 types of occupational training covered by this visa:

• workplace training required for registration
• structured workplace training to improve skills in an eligible occupation
• training that promotes capacity building in a foreign country. This includes overseas qualification, government support or professional development

Australian Commonwealth Government agencies do not need to submit a nomination application.

You must not engage in or intend to engage in activities that will have adverse consequences for Australian citizens or permanent residents for:

• employment or training opportunities, or
• conditions of employment.

This can include where:

• a current employee who is an Australian citizen or permanent resident will be displaced by the visa holder, or
• you are not giving similar occupational training opportunities to employees who are Australian citizens or permanent residents.

You must directly provide the occupational training, unless you are an Australian Commonwealth Government agency or have an exemption.

Exemptions

You may be exempt from the requirement to provide occupation training directly if:

• a national Australian Government agency supports the sponsor
• the sponsor is identified in the legislative instrument
• the occupational training is provided as outlined in the legislative instrument.

There must be no adverse information known about your business or any person associated with your business, unless it is reasonable for us to disregard this information. See more about adverse information.

You are responsible for providing the training program that you nominated. You must meet your obligations as a Temporary Activities Sponsor. See more about temporary activities sponsor obligations.

You are responsible for meeting these obligations even if you appoint someone, such as a migration agent, to act for you.

You must also follow Australian workplace laws. All work undertaken by Training visa holders must be paid in line with minimum wages. You can find information on required minimum wages at the Fair Work Ombudsman website.

It is illegal to exploit migrant workers. This includes anyone doing unpaid workplace-based occupational training with your business. If you exploit them, you could be fined, jailed and/or prevented from hiring more temporary migrant workers for a period. Learn more at Information for employes and labour hire organisations.

If any of the following happens, you must tell us in ImmiAccount:

• your address or contact details change
• the person you sponsored does not start in the position, program or activity we granted the visa for
• the person you sponsored unexpectedly ends their position, program or activity we granted the visa for
• there are changes to the formal arrangement or agreement with the person you sponsor
• you change the date of when the person you sponsored will end their position, program or activity
• your legal entity ceases to exist.
